Payment and Refund Policy
OMLAB DIGITAL LTD (trading as OnlyMonster)
IMPORTANT NOTICE: This Payment & Refund Policy forms part of the OnlyMonster Agreement and must be read together with our Terms and Conditions (in particular Sections 10, 12, and 14), Privacy Policy, and Data Processing Agreement. In the event of any conflict, the order of precedence set out in the Terms and Conditions shall apply: (1) DPA, (2) Terms and Conditions, (3) Privacy Policy, (4) Cookies Policy. This Policy does not supersede or vary any provision of the Terms and Conditions.
1. Scope and Binding Nature
This Payment & Refund Policy (“Policy”) governs all payment, billing, subscription, and refund arrangements relating to the OnlyMonster software-as-a-service platform operated by OMLAB DIGITAL LTD, a company incorporated in the Republic of Cyprus (registration number HE 478780), with its registered office at Ifigeneias 14, 3036, Limassol, Cyprus.
By initiating any payment or adding funds to your OnlyMonster Balance, you acknowledge that you have read and agree to be bound by this Policy and by the Terms and Conditions, in particular Section 10 thereof (Financial Terms), which are incorporated herein by reference.
2. Subscription Model and How Billing Works
2.1. Subscription-Based Access
Access to paid features of the OnlyMonster Service is provided on a subscription basis. Subscription plans are available for periods including, but not limited to, one (1), three (3), or six (6) months, as may be offered by OnlyMonster from time to time.
2.2. Plan Selection and Informational Suggestions
Upon adding one or more Profiles or Accounts to the Service, the system may automatically suggest a subscription plan based on objective technical parameters associated with those Profiles (clause 10.1 of the Terms and Conditions). You acknowledge that:
- any such suggestion is informational only and does not constitute a binding recommendation;
- the final selection of a subscription plan and subscription period is made solely by you;
- OnlyMonster does not guarantee that any suggested plan will result in specific financial outcomes or revenues.
2.3. No Automatic Recurring Charges
OnlyMonster does not apply automatic recurring charges at this time (clause 10.3 of the Terms and Conditions). You will not be charged unless you explicitly initiate a payment action within the Service by clicking the applicable payment button (e.g. “Make a payment”). If automatic renewal functionality is introduced in the future, this Policy will be updated and you will be given prior notice as required by applicable law.
3. The OnlyMonster Balance
3.1. Nature of the Balance
To access paid features of the Service, you may be required to add funds to your internal OnlyMonster account balance (“Balance”) in accordance with clause 10.2 of the Terms and Conditions.
Important: The Balance is a prepaid credit account within the Service. It does not constitute, and must not be treated as, any of the following: a bank account or bank deposit; a stored value account; electronic money (e-money) within the meaning of the Electronic Money Directive (2009/110/EC) or any equivalent national legislation; a payment account; a wallet holding monetary value redeemable outside the Service.
3.2. Characteristics of the Balance
By adding funds to your Balance, you acknowledge and agree that (clause 10.4 and 10.5 of the Terms and Conditions):

3.3. Adding Funds to the Balance
Payments to add funds to your Balance are processed by our authorised payment processors. Accepted payment methods are as displayed at the time of payment within the Service and may vary by jurisdiction.
All transactions are processed in the currency displayed at the time of payment. Currency conversion, where applicable, is handled by your payment provider or card issuer. OnlyMonster is not responsible for exchange rate differences or fees applied by your financial institution.
4. Pricing and Price Changes
4.1. Current Pricing
Subscription plan pricing is displayed within the Service at the time of selection. All prices are exclusive of any applicable taxes, duties, or levies unless stated otherwise.
4.2. Taxes and VAT
Where applicable law requires, VAT or other applicable taxes will be added to the displayed price. The applicable tax rate will depend on your country of residence or establishment. OnlyMonster will provide a tax invoice or receipt where required by law.
4.3. Price Changes
OnlyMonster may modify pricing or subscription plans upon reasonable advance notice to you (clause 10.7 of the Terms and Conditions). Any price changes will apply only to future payments and will not affect subscription periods that have already been paid for. Notice of price changes will be communicated via email to your registered account address or via an in-Service notice.
5. Payment Processing and Security
All payments are processed by our authorised payment processors. OnlyMonster does not collect, store, or process full card numbers. All payment card data is handled exclusively by authorised payment processors in accordance with PCI DSS standards. Tokenised payment references only are retained by OnlyMonster for billing and reconciliation purposes.
By initiating a payment, you represent that you are authorised to use the selected payment method and that the billing information you provide is accurate and complete.
6. Refund Policy
6.1. General Principle: Balance Credit Refunds
Refunds are available. However, in accordance with clause 10.4 of the Terms and Conditions, refunds are processed exclusively by crediting the unused portion of paid funds to your OnlyMonster Balance. Cash refunds to the original payment method are not provided, except in the circumstances described in Section 6.5 below (Statutory Rights) or where required by applicable law.
6.2. Refunds Upon Cancellation or Profile Deletion (Pro-Rata Balance Credit)
If you cancel a subscription, request deletion of a Profile or Account, or otherwise discontinue use of the Service before the end of a paid subscription period, the unused portion of fees will be returned to your Balance on a pro-rata basis, calculated as follows:

6.3. Refunds for Service Unavailability
If the OnlyMonster Service experiences significant downtime or unavailability directly attributable to OnlyMonster's infrastructure (and not to third-party platforms, force majeure events, or actions beyond OnlyMonster's reasonable control), affected users may apply for a Balance credit in respect of the affected subscription period. Such applications are subject to OnlyMonster's reasonable assessment and verification of the reported issue.
Claims for service unavailability credits must be submitted to [email protected] within 14 calendar days of the relevant period of unavailability.
6.4. Non-Refundable Items
The following are not eligible for refund or Balance credit, except where required by applicable mandatory law:
- Subscription fees for periods already consumed or partially consumed where cancellation is requested after the subscription period has commenced, other than the pro-rata unused portion described in Section 6.2.
- Fees relating to periods during which your Account was suspended due to your breach of the Terms and Conditions (clause 2.3 and Section 7 of this Policy).
- Referral commissions, promotional credits, or any benefit received under OnlyMonster's referral programme.
- Any fees incurred as a result of currency conversion or payment processing fees applied by your financial institution.
6.5. Statutory Rights and Mandatory Consumer Protections
Nothing in this Policy limits or excludes any statutory right to a refund that you may have under applicable mandatory consumer protection law (including, where applicable, EU Directive 2011/83/EU on Consumer Rights, UK Consumer Rights Act 2015, or equivalent legislation in your country of residence).
In particular, where you are a consumer (and not a business user) and applicable law provides a right of withdrawal from a distance contract, the following applies:
Right of withdrawal (consumers only, where applicable law applies):
You may have the right to withdraw from this contract within 14 calendar days of concluding it, without giving any reason, and to receive a full cash refund to your original payment method. However, please note that by using the Service immediately upon payment, you may be expressly requesting that we begin performing the contract before the withdrawal period expires, and you acknowledge that you may lose your right of withdrawal once the Service has been fully performed. OnlyMonster is a B2B SaaS platform. The statutory right of withdrawal may not apply where you are accessing the Service for purposes related to your trade, business, or profession. If you are uncertain whether these rights apply to you, please contact us or seek independent legal advice.
7. Suspension, Withholding of Funds, and Account Termination
7.1. Inactive Subscription
If your Subscription becomes inactive (including due to insufficient Balance to cover the Subscription payment), OnlyMonster may, in accordance with clause 10.6 of the Terms and Conditions: (i) suspend the Profile's access to paid features; (ii) restrict the creation of new Profiles or Accounts; (iii) require Balance funding and successful Subscription renewal before access is restored.
7.2. Withholding During Investigation
During any period of suspension or while investigating a suspected breach of the Terms and Conditions, OnlyMonster may withhold any payments, Balance credits, or other amounts that would otherwise be due to you (clause 2.3(e) of the Terms and Conditions). If OnlyMonster determines that you have breached the Terms and Conditions, such withheld funds may be forfeited.
You acknowledge that the withholding of funds pursuant to this clause is a proportionate measure to protect OnlyMonster's legitimate interests in preventing fraud, misuse, and financial loss, and does not constitute a breach of this Agreement.
7.3. Referral Abuse
In accordance with clause 2.4 of the Terms and Conditions, OnlyMonster strictly prohibits self-referral and abuse of the referral programme. Any Balance credits or referral rewards obtained through prohibited conduct may be revoked without notice, and the relevant Accounts may be suspended or permanently terminated.
7.4. Termination and Balance on Termination
Upon termination of your Account (whether by you or by OnlyMonster for cause), any remaining Balance will be forfeited and will not be refunded or credited, except: (a) where the termination is effected by OnlyMonster without cause, in which case OnlyMonster will credit the unused pro-rata Balance to you; or (b) where required by applicable mandatory law.
8. Chargebacks and Payment Disputes
If you believe a charge has been made in error, please contact OnlyMonster's support team at [email protected] before initiating a chargeback with your payment provider. We will endeavour to resolve billing disputes promptly and in good faith.
Initiating a chargeback without first contacting OnlyMonster may result in:
- Immediate suspension of your Account pending investigation;
- Reversal of any Balance credits associated with the disputed transaction;
- Forfeiture of the disputed amount if the chargeback is found to be unwarranted.
OnlyMonster reserves the right to challenge chargebacks it considers to be unwarranted and to provide payment processors with supporting evidence of legitimate transactions.
9. How to Request a Refund or Balance Credit
To request a refund or Balance credit under this Policy, please contact us using the details below and provide the following information:

10. Data Protection and Payment Data
Personal data collected in connection with payments (including name, billing address, payment reference, and transaction history) is processed by OMLAB DIGITAL LTD as Data Controller in accordance with our Privacy Policy. Payments are processed by authorised payment processors, who act as independent controllers for payment processing purposes and as our sub-processor for billing and fraud prevention. Our authorised payment processors' privacy practices are governed by their own privacy policy.

11. Governing Law and Dispute Resolution
This Policy is governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts of Nicosia, Cyprus, in accordance with clause 13 of the Terms and Conditions.
Notwithstanding the foregoing, nothing in this Policy limits any mandatory consumer rights you may have under the law of your country of habitual residence.
12. Changes to This Policy
OnlyMonster may update this Policy from time to time. Material changes will be communicated to registered users via email to the address registered in your Account or via an in-Service notice, in advance of the changes taking effect, in accordance with clause 14.2 of the Terms and Conditions. Continued use of the Service after the effective date of the updated Policy constitutes your acceptance of the changes.
